Washington Mobile Home Park Tenants Win Class Action

The class action lawsuit settlement requires mobile-home park owners to drop the conversion language from its leases and stop using contracts that allowed them to automatically convert an annual lease to a month-to-month lease. The San Luis Obispo County Board of Supervisors has directed planning staff to begin developing a mobile-home park overlay zone that would contain incentives for park owners to protect and preserve the county’s largest stock of affordable housing — mobile-home parks. Read More here.

Wilsonville, OR…Appellate court reverses decision about city’s mobile home park ordinance

In 2005 the city of Wilsonville enacted a more stringent mobile home park closure ordinance then the rest of the state of Oregon. A park owner sued the city over the ordinance and won, with the circuit court ruling that the ordinance is unconstitutional. Two days ago, the Oregon appellate court reversed that decision. Guggenheim v. City of Goleta case will be reviewed en banc by the Court of Appeals for the Ninth Circuit

The major anti rent control ruling of Guggenheim v. City of Goleta may be reversed. The three-judge panel opinion shall not be cited as precedent by or to any court of the Ninth Circuit.” En banc review means that a panel of 11 judges will now review and decide the case.
